The Kagan nomination: Tom Tomorrow draws lessons from parallel worlds that are almost as goofy as ours

>

I'd still like to believe in the optimistic view of Elena Kagan promoted by Larry Lessig, as a progressive and a go-getter who's going to whip the Court into shape, but hey, I don't know, and I have a feeling that isn't who the president thinks she is either. But then, as I keep pointing out, I rarely have much idea what the president is thinking, except when it's clear that he's called on Master Rahm Emanuel to bring out the scientific measuring equipment to locate the absolute center of a political issue -- and never mind that, because of a failure of error correction in that equipment, it usually fails to adjust for the rightward flight of the mythical "center," which these days is usually found, according to the instruments, trapped in a canyon that was once labeled "Far Right," where even onetime Mr. Conservative Extremist Barry Goldwater rarely visited. -- Ken
